Monday?s announcement of the President?s selection of Michael B. Mukasey as his third attorney general overshadowed another, surprising aspect of the press announcement. He also stated that he had revisited his decision to have Solicitor General Paul Clement serve as Acting Attorney General, vesting the authority instead in Peter Keisler, the head of the Civil Division, whose departure back to private law practice had been announced just a few weeks earlier.
